General Terms and Conditions

for orders via IB Art Shop
Status: January 2026


1. Scope

1.1 These General Terms and Conditions (“GTC”) apply to all contracts between IB Art Shop (Seller) and customers via the online store.

1.2 An entrepreneur is a person acting in a commercial or professional capacity.

1.3 A consumer is a natural person acting outside commercial activity.

1.4 The website may contain external links. We assume no liability for third-party content.

1.5 All website content is protected intellectual property.

1.6 Purchase grants ownership of the physical product only. Copyright remains with the artist.

1.7 Further use requires written permission.


2. Conclusion of Contract

2.1 Product listings are invitations to submit offers.

2.2 By ordering, the customer accepts these GTC and the privacy policy.

2.3 Orders may be placed via checkout or email.

2.4 Order data is stored and emailed.

2.5 Communication occurs electronically.

2.6 The Seller may accept the offer within three days by confirmation, shipment, or payment request.

2.7 Orders may be rejected in case of false data or unpaid debts.

2.8 Minor color deviations do not constitute defects. Obvious pricing or display errors may be corrected.

2.9 Promotional offers are time-limited.

2.10 Force majeure may extend delivery time. Liability exists only as required by law.

2.11 Legal notices must be in text form (e.g. email).


3. Prices & Payment

3.1 All prices are final prices in EUR.
If VAT is not charged, this is done under §19 German VAT exemption (small business rule).
Shipping/customs outside Germany are borne by the customer.

3.2 Available payment methods are displayed online.

3.3 Payment methods may be restricted.

3.4 Goods remain property of the Seller until fully paid.

3.5 Shopify Payments processed via Stripe Europe Ltd.


4. Delivery

4.1 Delivery is made within the Seller’s delivery area to the address specified by the Customer during checkout. Self-collection is excluded unless expressly agreed.

4.2 If delivery is made to a pickup location, the Customer must collect the shipment within the specified time. Failure to collect may result in return shipping. Reasonable handling and return costs may be charged.

4.3 If delivery fails due to reasons attributable to the Customer, the Customer bears the additional reasonable costs incurred. The risk of accidental loss or deterioration passes to the Customer only upon delivery.

4.4 If the Customer acts as an entrepreneur, risk passes upon handover to the carrier.

4.5 Ownership of goods transfers to the Customer upon confirmed delivery. From that point, the Customer bears the risk of loss or damage not caused by the Seller.

4.6 Customers are requested to inspect goods upon delivery and report visible transport damage promptly. Failure to report does not affect statutory rights. Damage claims should be reported within seven (7) days where possible.


5. Liability

5.1 The Customer must inspect goods immediately after receipt.

5.2 The Customer has statutory warranty rights.

5.3 In the event of justified complaints, the Seller may repair or replace the goods in accordance with statutory law.

5.4 Minor color variations caused by technical reproduction processes do not constitute defects.

5.5 Partial defects do not entitle rejection of the entire delivery unless the remaining goods are unusable.

5.6 The Seller is not liable for defects known to the Customer at the time of purchase.

5.7 Complaints may be rejected if no defect exists under consumer protection law.

5.8 Warranty does not cover damage resulting from improper use, normal wear, or negligent handling.

5.9 Mandatory statutory liability, including product liability, remains unaffected.

5.10 Damage claims are subject to statutory limitation periods.

5.11 The Seller is fully liable in cases of intent or gross negligence. For ordinary negligence, liability is limited to foreseeable damage typical for the contract and never excludes injury to life, body, or health.

5.12 Warranty claims expire according to statutory provisions.


6. Governing Law & Dispute Resolution

6.1 German law applies excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain mandatory protections of their country of residence.

6.2 Contract language: German within Germany; English within the EU.

6.3 The Seller is not obliged or willing to participate in consumer arbitration proceedings.

7. Changes to the Terms

The Seller may update these terms at any time. Changes apply to future contracts only and will be published on the website.


8. Severability Clause

If any provision is invalid, the remaining provisions remain effective.
